2014’s Third Clean Politics Advisory Committee Meeting
Allowing for Transparency and External Public Supervision of Governance
On the morning of November 6th, 2014 the Agency Against Corruption (AAC) of the Ministry of Justice held its third session of the Clean Politics Advisory Committee of 2014. The meeting was presided over personally by AAC Director General Lai Che-Hsiung. During the meeting the “Status and Implications of Legislation for the Legal Domestication of the United Nations Convention against Corruption” report and the “National Fitness Environment Improvement and Fitness Island Establishment Plan” report were submitted. In addition, results of preliminary review of cases archived during the current time period and cases submitted for review by the committee were reviewed during the meeting.
Topics presented during the “Status and Implications of the Legal Domestication Legislation of the United Nations Convention against Corruption” report included the background and content of the convention as well as the process that the Ministry of Justice is using to domestically internalize the convention’s regulations. Because the enforcement act for the convention is currently being reviewed by the Legislative Yuan, an explanation was given regarding important issues such as “whether a unilateral obligation will be created by the legal domestication of the convention” and the “legal hierarchy of the convention and Taiwan’s corresponding enforcement act”. If the enforcement act passes the third reading of the Legislative Yuan, the Ministry of Justice will continue to actively review and assess Taiwan’s current legal system to ensure that it is aligned with international law and global anti-corruption trends.
In order to ensure that city or county affiliate organizations of the Sports Administration of the Ministry of Education who received subsidies for the execution of the “Improvement of National Sports Environment and Sports Island Establishment Plan” had not engaged in the falsifying documents or other fraudulent behavior, the AAC requested that the relevant government employee ethics units carry out an assessment the project funds. The assessment was executed in two stages. A total of 23,354 cases were examined, with corresponding subsidy amounts totaling NTD 625,782,275. The results of the assessment found 10 types of malfeasant behavior and produced 12 categories of suggestions for reform. 22 cases of general illegal behavior were referred to investigative authorities for investigation. Of the NTD 4,850,663 subsidy overpaid , NTD 917,388 has been returned. The examples of malfeasant behavior found and corresponding recommendations for reformation for this case were submitted by the AAC to the Sports Administration of the Ministry of Education for their reference in executing follow op operations. It is our hope that as the ideals of nationwide participation in sports and fitness activities are promoted and that we can also prevent the misuse of public funds and criminal behavior.
