    Responses and Management Measures to the Concluding Observations and Recommendations of the International Review of Taiwan’s 2nd National Report on the Implementation of the UNCAC

    On April 19, 2023, the Tsai Pi-Chung, Deputy Minister of Justice, invited representatives from the Judicial Yuan, the Examination Yuan, the Control Yuan, and the Executive Yuan to an inter-ministerial meeting to jointly confirm the responses to the concluding observations and recommendations of the 2nd National Report on the Implementation of the UNCAC, including the expected implementation measures, performance targets, and the scheduled completion date, as well as the subsequent inclusion of measures as part of the National Integrity Building Action Plan, and to complete the draft amendments to the National Integrity Building Action Plan. The meeting resolved to include the concluding observations and recommendations on the implementation measures listed in the Action Plan, and the lead agencies and co-agencies will implement them accordingly, to respond to the expectations of the International Review Committee on implementing the UNCAC in Taiwan through concrete actions.

    Making friends with integrity: 2022 Indo-Pacific Youth Exchange on Anti-Corruption and Taiwan’s stupendous efforts to implement the UNCAC Next exchange event will be held in 2023

    The Agency Against Corruption (AAC) cooperated with The National Democratic Institute (NDI), Transparency International Taiwan (TICT), The Open Culture Foundation (OCF), and Taiwan Association for Schools of Public Administration and Affairs (TASPAA) for Indo-Pacific Youth Exchange on Anti-Corruption. During the international review of Taiwan’s second report under the United Nations Convention against Corruption (UNCAC), AAC invited 13 young cadres of NGOs from 4 countries including the Philippines, Indonesia, Sri Lanka, Papua New Guinea, together with 12 undergraduate and graduate students in our country as observers to participate in the review meeting. AAC held a workshop for observers to exchange of opinions after the review meeting. Through the on-site visits, they gained a better understanding of how the government procurement integrity platform operates in Danjiang Bridge Project of Directorate General of Highways, MOTC, and what the measures related to transparency in the customs administration in Keelung Customs Taipei Port of Customs Administration, MOF. This series of activities culminated in The Indo-Pacific Youth Dialogue on Anti-Corruption and Transparency Initiatives on September 2. All participants were deeply impressed by Taiwan’s progress in building capacity in integrity. This event not only responded to the Concluding Observations on the ROC’s Initial Report under the UNCAC in 2018, which revealed that "Taiwanese civil society organizations and academia have played an important role in combating corruption and promoting integrity, which is enough to serve as a model for the Asia-Pacific region.", but also to the various commitments on anti-corruption and transparency made by our country at The Summit for Democracy hosted by the United States in December 2021. As observers, Indo-Pacific and Taiwan youths jointly participated in the Review Meeting of the Second National Report under the UNCAC held in the Conference Room of the Howard Civil Service International House on August 30. All observers also actively communicated in the discussion workshop after the review meeting, and enthusiastically shared their observations and feedback on that day. In addition, they visited achievements of Integrity Platform for the Danjiang Bridge Project and the administrative transparency measures in Keelung Customs (Taipei Port Office) on September 1st. In order to share precious experiences and discuss about integrity issues, Indo-Pacific Youth Dialogue on Anti-Corruption and Transparency Initiatives was held in Metro Link International Hall of Taipei Metro on September 2nd. “Freedom, democracy, integrity and transparency are universal values worldwide. In collaboration with NDI, AAC wants to make a fresh start with international integrity cooperation,” said AAC Director-General Rong-Song Zhuang as he served as a keynote speaker. TICT Executive Director Yi-Jung Wu said, “Only the integrity and efficient government serves as a blessing for people. I hope that our youths exchange their opinions and bring the valuable experiences back to where they grew up. Then the experiences will sprout and be in bloom of value.” NDI Taiwan Resident Director Alfred Wu pointed out, “Recently, Taiwan have gained outstanding achievements in Open Government. I hope that this activity could earn youths’ recognition of integrity and transparency so that they’ll be encouraged to devote in the integrity career.” AIT Legal Liaison Section Chief Ty Cook said, “Corruption has a serious negative impact on private and public sectors. The Federal Bureau of Investigation (FBI) will make all-out efforts to collaborate with everyone on combat corruption and protect integrity.” Breaking Down Barriers to Protect the Values of Integrity and Transparency In the first half of Indo-Pacific Youth Dialogue, 4 NDI Indo-Pacific youths, Almas (from Indonesia), Angelyn (from the Philippines), Terans (from Sri Lanka) and Desmond (from Papua New Guinea), gave the lectures on the observation of Anti-Corruption and Transparency Efforts in Taiwan and the Indo-Pacific. NDI Taiwan Resident Director Wu served as a moderator and AAC Deputy Director-General Feng-Liang Shen, TICT Vice Executive Director Yu-Jung Lee and OCF Deputy CEO Lulu Keng served as panelists. In the second half of Indo-Pacific Youth Dialogue, 3 Taiwan youth representatives, Charlotte Hsieh (from National Taipei University), Melina Nuñez Sanabria (from Shih Hsin University) and Cheng-Hsun Huang (from National Chengchi University), gave the lectures on the observation of Taiwan’s Anti-Corruption Efforts and National Adherence to the UNCAC. TICT Vice Executive Director Hsin-Chung Liao served as a moderator and AAC Deputy Director-General Feng-Liang Shen, TASPAA Secretary General Hsin-Fang Tsai, NDI Program Officer Penghsuan Lee and OCF Deputy CEO Lulu Keng served as panelists. To make friends with integrity, it was the first time AAC and NDI cooperated in the series of activities of Indo-Pacific Youth Exchange on Anti-Corruption. This series of activities combined anti-corruption energies from the government, domestic and foreign Non-Governmental Organizations, and academia, showing Taiwan’s efforts on protecting the universal values of integrity to the world. To sum up, the series of activities struck a responsive chord and we made a wishful promise that we will collaborate together once again in 2023 to write down the new chapter of international integrity exchanges.

    AAC Retirement Ceremony of Senior Executives in the last-half year of 2022

    “The AAC Retirement Ceremony of Senior Executives in the last-half year of 2022” was held on June 21st, 2022. The Director-General Zhuang, Rong-Song hosted the ceremony, and five senior executives who attended the ceremony included Tsai Chin-Fa, Director of Government Ethics Office of Department of Secretariat of National Security council, Ke Ying-Yan, Director of Government Ethics Office of Academia Historica, Wang Hong-Wen, Director of Government Ethics Office of Ministry of Civil Service, Luo Shi-Lang, Director of Government Ethics Office of Mainland Affairs Council, Wei Han-Liang, Director of Government Ethics Office of Customs Administration of Ministry of Finance Taipei Customs. Director-General Zhuang presented certificates of appreciation on behalf of all the ethics officers to retirees, recognized their dedications to anti-corruption work, wished them have a happy and healthy retirement, and encouraged them to come back to the big family of AAC from time to time.

    "Public-Private Partnership for Corporate Sustainability, Smart Integrity for Service Enhancement" Integrity Platform for Enterprise Services - "2022 Foreign Business and Enterprise Integrity Forum"

    In order to implement the United Nations Convention Against Corruption (UNCAC) requirements on anti-corruption measures in the private sector, the Ministry of Justice (MOJ) continues to advocate corporate integrity and compliance with laws and regulations, promote streamlined processes and convenience to enhance administrative efficiency, deepen public and private sector exchanges and forge a consensus in order to establish anti-corruption partnerships and enhance Taiwan’s global competitiveness. On June 17, 2022, the MOJ and Taipei City Government jointly hosted the "2022 Foreign Business and Enterprise Integrity Forum " and marked a new era in corporate integrity by unveiling a dedicated integrity platform for enterprise services. Representatives from foreign and local enterprises in the financial service industry, biotechnology industry, MICE and tourism industry, as well as ICT industries were invited to attend the conference and representatives from the industry and NGOs conducted cross-disciplinary and two-way discussions and exchanges on issues such as "corporate integrity," "administrative transparency," "corporate sustainability " and "digital governance." The forum was kicked off with a speech by Minister Tsai Ching-hsiang of the Ministry of Justice and Deputy Mayor Tsai Ping-kun of the Taipei City Government, followed by Commissioner Lin Chung-chieh of the Department of Economic Development of the Taipei City Government, Liao Hsin-chung, Vice Executive Director of Transparency International Chinese Taipei and Michael Chen, Regional Manager, Partner Organization, Cisco Greater China. The invited speakers delivered speeches covering Taipei City's investment environment, transparency and integrity and corporate sustainability issues. A panel discussion was then moderated by Deputy Director-General Shen Feng-Liang of the Agency Against Corruption (AAC), who invited prosecutor Hsu Hsiang-chen of the Taipei District Prosecutor’s Office, Robert Feng, Head of Systems Engineering, Cisco Taiwan, and Simon Lu, Commissioner of the Department of Information Technology of the Taipei City Government to engage in a dialogue from multiple perspectives. In his speech, Minister Tsai pointed out that the main spirit of corporate integrity management is "integrity governance," which is to follow the law and fulfill social responsibility. Transparency International recently announced the 2021 Corruptions Perception Index (CPI), in which Taiwan ranked 25th out of 180 countries and regions with a score of 68, the best results ever. It fully demonstrates Taiwan's achievements in fostering integrity have been recognized internationally. The MOJ is particularly grateful for the joint and concerted efforts of the public and private sectors and the support of all citizens to an  environment of integrity in Taiwan. The UNCAC emphasizes the private sector as an integral part of the anti-corruption system and encourages the private sector to also set codes of conduct, avoid conflicts of interest and enhance transparency. This year, the MOJ requested the AAC to incorporate the spirit of openness and transparency found in the "Government Procurement Integrity Platform" and its successful operation to promote the pilot "Integrity Platform for Enterprise Services" in collaboration with the competent authorities. For example, the Platform provides consultation on the issues of "Abuse of Public Power for Private Profit and Convenience for People " for enterprises and assist enterprises in strengthening integrity governance and compliance with laws and regulations in order to achieve the goals of streamlined processes and convenience, corporate integrity, public-private partnership and sustainable development, thereby creating a clean and quality investment environment. In his speech, Deputy Mayor Deputy Mayor Tsai Ping-kun added that the global economic activities have been greatly affected by the COVID-19 epidemic in recent years and the economy in the post-epidemic era must strike a balance between the epidemic situation in Taiwan and practicality. Therefore, the Taipei City Government's economic development policies have been transformed in tandem, including a more pro-active approach to digital transformation and upgrading of industries and a sound business environment. The government's role is to build a friendly and open investment environment and provide more convenient business services. For example, the Taipei City Government establishes Government Procurement Integrity Platforms for all major procurement and infrastructure projects, which effectively maintains fairness and openness in attracting investment, eliminates improper interference from outside and establishes a transparent administrative mechanism. Deputy Director-General Shen Feng-Liang of the AAC pointed out during the panel exchange forum that in recent years, the AAC has continued to work with various competent agencies to organize corporate integrity forums and business seminars to establish public-private partnerships and jointly promote integrity governance, in the hope of deepening public-private exchanges and corporate services, so that the efforts resonate with all corners of society. This forum demonstrates the public sector's determination to improve the quality and convenience of services provided by public agencies and to actively encourage enterprises in implementing integrity rules and regulations. Through the discussion between public and private sector representatives and experts and scholars, as well as the sharing of experiences of leading enterprises, the event brought together the combined strengths of industry, government and academe and promoted the understanding of corporate integrity and governance issues among participating foreign businesses and enterprise representatives. In the future, the AAC will continue to work with various agencies to provide simple and convenient measures to assist enterprises in strengthening integrity governance and actively build a network of public-private collaboration and inter-disciplinary cooperation to create a high-quality and clean investment environment and achieve a win-win situation for the sustainable development of the country and enterprises.

    On May 17th, 2022, Minister Tsai, Ching-Hsiang of the Ministry of Justice hosted the opening ceremony of the “The 48th Training Class of Government Ethics Personnel” by videoconference at AAC.

    “The 48th Training Class of Government Ethics Personnel” was held on May 17th , 2022 by videoconference at AAC. The Minister of Justice Tsai, Ching-Hsiang hosted the ceremony and delivered a speech, the ceremony was completed successfully in a simple and solemn form. In his speech, the Minister encouraged all new government ethics personnel to adhere to the priority of moral character, cultivate professional ability, focus on corruption prevention before corruption investigation, deepen partnership, and have the courage to take responsibility.

    Professionalism | Integrity | Proactivity | Service---New AAC Director-General, Chuang Rong-Song, Hosts First Staff Meeting, Unveils Four Goals and Encourages All Ethics Officers Across the Nation

    AAC Director-General Chuang, who chaired the staff meeting on May 24th, 2022. He first thanked to the five former Director-Generals for building a solid foundation for AAC, which has made the work of ethics to be "thriving, impressive and admirable.” After Chuang listened attentively to the working reports of each division and office, he shared his own experiences and enthusiasm. He not only praised ethics officers for burnishing the brand image of AAC, but also encouraged them with the following four key points, with the expectation that all will work together to build a government with integrity, competency and transparency. I. Professionalism: Continuously refine basic skills to enhance professionalism and competency as well as familiarity with the laws and regulations, such as the Act on Recusal of Public Servants Due to Conflicts of Interest, the Act on Property-Declaration and the Ethics Guidelines for Civil Servants, or the specific laws and regulations for different agencies which should all be mastered and familiarized with. II. Integrity: Sweep before one’s own door, and uphold upstanding conduct and integrity. III. Proactivity: Take the initiative to contact and interact with colleagues, grasp the potential risks in each agency’s affairs, review official secrets and ensure security at all times while taking precautionary measures to prevent colleagues from violating the law. IV. Role Transition: all ethics colleagues have to change the mindset and uphold the spirit of service, to prevent incidents beforehand instead of the investigation of accountability after the fact. Such as the AAC recent promotion of the Government Procurement Integrity Platform, Foreign Business and Enterprise Integrity Forums etc., which all demonstrate the implementation of the concept of service.

    Minister Tsai attended the Finance Forum 2021“Clean, competent, and compliant governance – sustainable business with integrity” held by Bank of Taiwan on October 27th, 2021.

    To combat unscrupulous financial consultants who fail to comply with the "Ten Commandments of Financial Consultants" and take advantage of the trust of clients to misappropriate accrued wealth, Premier Su of the Executive Yuan requested at the Central Integrity Committee 2020 that Financial Supervisory Commission and State-owned Banks step up supervisory efforts and focus on cultural shaping and changes in order to form an anti-corruption atmosphere.   Under the joint guidance of the Ministry of Finance, the Ministry of Justice, and the Financial Supervisory Commission, the Bank of Taiwan invited the State-owned Banks to hold the Finance Forum 2021“Clean, competent, and compliant governance – sustainable business with integrity” on October 27th, 2021. Tsai Ching-Hsiang, Minister of Justice, Su Jain-Rong, Minister of Finance, Huang Tien-Mu, Chairperson of the Financial Supervisory Commission, and the chairmen of State-owned Banks all gathered to sign the “Clean and Competent Enterprise - Ethical Financial Consultants” Declaration, conveying their determination to continuously develop culture of integrity and nurture incorruptible qualities in employees.   In his speech, Minister Tsai pointed out that integrity is the core value of an enterprise, and that compliance with laws and regulations is the practice of corporate integrity. Accordingly, Agency Against Corruption’s implementation of the United Nations Convention against Corruption (UNCAC) has expanded from the public sector to the private sector in hopes of establishing anti-corruption partnerships and increasing Taiwan’s global competitiveness. Cheng Ming-Chian, Director-General of Agency Against Corruption, also participated in the forum to discuss with the honored guests over the topic “Risk Management and Control in Wealth Management Promotion” and deepen the value of integrity.

    MOJ and MOEA Hold 2021 Corporate Governance and Business Ethics Conference on December 1

    The Ministry of Justice (MOJ) and Ministry of Economic Affairs (MOEA) jointly held the 2021 Corporate Governance and Business Ethics Conference on December 1 to launch a campaign against private sector corruption as stipulated in the United Nations Convention against Corruption (UNCAC) and to facilitate the implementation of the National Integrity Building Action Plan. The purpose of the event was to strengthen corporate integrity, build consensus on combating corruption in the private sector, and improve governance mechanisms to help Taiwan maintain a competitive edge in the international community. The organizers invited professionals from all fields, including foundations under the MOEA and MOEA-affiliated agencies and institutions, the chairs and CEOS of direct and indirect investment companies, TWSE/TPEx-listed companies, foreign-owned enterprises, and CSR award-winning benchmark enterprises, as well as representatives of industry, academia, government, and research institutes to engage in interdisciplinary bilateral discussion and exchanges. Minister Ching-Hsiang Tsai of MOJ and Deputy Minister Chern-Chyi Chen of MOEA delivered remarks at the event. Stan Shih, chair of the StanShih Foundation and founder of the Acer Group, gave a keynote speech titled “Viewing ESG from the Perspective of Best Practices in Leadership.” Afterward, Director-General Ming-Chian Cheng of the Agency Against Corruption, speakers from state-owned enterprises under the MOEA, and other representatives from the public and private sectors shared their outlooks, and ideas on strengthening corporate governance, integrity, and ethics in roundtable discussions on “ESG Paradigms and Ethical Management” and “Innovation, Integrity, and Internationalization.”

    Meetings for the Mid-Term Report on Concluding Observations from Review of the Initial Report under the United Nations Convention against Corruption

        After the ROC’s initial report under the United Nations Convention against Corruption was published in March 2018, the Executive Yuan held review meetings in August 2018 and invited 5 international anti-corruption experts as review committee to interview the government agencies and NGOs in Taiwan. A press conference was held, where 47 concluding observations were given.     To confirm the specific means of implementation in concluding observations, the Executive Yuan has prepared 371 performance indicators to be updated with progress by each competent authority every six months. The Ministry of Justice will submit the management and monitoring results to the Central Integrity Committee, Executive Yuan for continuous tracking.     The Ministry of Justice convened 4 meetings between April 27, 2020 to May 6, 2020. The Executive Yuan held a meeting on October 7, 2020 and invited experts and scholars and NGO representatives to participate in reviewing the implementation, conduct mid-term review, and prepare a midterm report to explain the implementation progress, initial results during this period of time, and the subsequent implementation and planning of relevant strategies.

    AAC held the first ever “Reunion Tea Party for Retired Anti-Corruption Workers” on December 10th, 2018. About 70 retired anti-corruption workers were invited to this event, and had a great time chatting with old colleagues, sharing their working experience and the life after retirement.
