The Agency Against Corruption Performed the “Major Construction Procurement Case Execution Status Project Re-examination” Called “Zhengben Cases”

With the recent Bade Affordable Housing Project public procurement corruption case, the general public has taken a great interest in the corruption levels of major government construction procurement projects. In order to ensure the quality of such projects and strengthen the corresponding anti-corruption early warning mechanisms, Minister Luo of the Ministry of Justice tasked the Agency Against Corruption” to actively carry out the “Major Construction Procurement Case Execution Status Re-examination Plan” and submitted the corresponding report to Premier Jiang after the Executive Yuan Meeting. After listening to the report, Premier Jiang of the Executive Yuan instructed that the AAC effectively in supervising and guiding government employee ethics units while investigating cases of malfeasance and potential risks of major construction procurement cases of the last 5 years. He also suggested that cases falling into this category be named “Zhengben Cases”. The predetermined range of this investigation project includes both central and local government agencies who accepted construction biddings from 2009 to 2013, signed contracts and are currently executing construction projects with a value of over NTD 200 million. These cases included both major construction procurement projects that were carried out according to the Public Procurement Act and public construction projects which used the public-private cooperation model as outlined in the Act for Promotion of Private Participation in Infrastructure Projects. The investigation was carried out using preventative and systematic review methods to effectively and actively preventing illegal corruption. According to the AAC’s initial estimates, there were a total of 1,402 major construction procurement cases from 2009 to 2013, with a total value of winning bids of NTD 1,082,137,190,000. The re-examination of these “Zhengben Cases” will be carried out by performing random checks according to the Public Procurement Act, the Urban Planning Law, the Land Expropriation Act and the Act for Promotion of Private Participation in Infrastructure Projects on major construction procurement cases and public infrastructure development cases that are considered vulnerable to corrupt. The investigation project is expected to be completed by the end of September of this year.
